PRE & POST NUPTIAL AGREEMENTS


At its core, marriage is a contract. For those that do not elect to enter into a pre or post-nuptial agreement, it is a contract with undefined terms that a court will dictate in the event something goes wrong. Those terms will depend on a number of factors provided by the law, as well as a number of factor outside the law, like where you live, your judge, etc. Finding out those terms through litigation typically takes a good amount of time, money, and aggravation.


By entering into a pre or post-nuptial agreement, the parties to the contract take control over the terms. Parties will know what to expect in the unlikely event that enforcement of the contract becomes necessary thereby substantially decreasing litigation costs.

The negative connotation around pre and post-nuptial agreements is unfortunate. It is a tool. The terms will be those to which the parties agree.
